At issue are questions of profound importance to all citizens living in a democratic society. At what point, for example, does a state at war have a guaranteed right to remove individuals from its midst, because of their perceived potential to do it harm, prior to any actual misdemeanours having been committed? How can we reconcile arbitrary arrest and confinement with the principles of law upon which our society rests?
